RESOLUTION TO AUTHORIZE PRELIMINARY SUBDIVISION APPROVAL (I.E., A VERTICAL SUBDIVISION) TO ALLOW FOR THE CONSTRUCTION OF AN OFFICE CONDOMINIUM COMPLEX TENTATIVELY NAMED  “PALM BEACH EXECUTIVE PLAZA”—FOR PROPERTY LOCATED AT 1877 BEACH BOULEVARD

 

            WHEREAS, on Thursday, April 1, 2004, the Biloxi Planning Commission held a public hearing in the Auditorium of the Dr. Martin Luther King, Jr., Municipal Building, 676 Dr. Martin Luther King, Jr. Boulevard, Biloxi, Mississippi, to hear Case No. 04-034, Sam Ly (owner) and Gulf Coast Investment Developers (applicant), a request for Preliminary Subdivision Approval to allow for the sale of tenant floor space to individuals within an approved office building complex (i.e., a vertical subdivision or condominium) to allow for the construction of an Office Complex tentatively named “Palm Beach Executive Plaza,” for the property located at 1877 Beach Boulevard; and           

            WHEREAS, the Planning Commission members were apprised of the particulars of the case, being made cognizant of the fact that the owner/applicants (Sam Ly and Gulf Coast Investment Developers) have proposed development of a Condominium Office Complex, whereby office space would be made available for sale to individual tenants; and

            WHEREAS, it was noted that the project is to be located on the site of the former Burger King Restaurant on Beach Boulevard, east of Camellia Street, if that street were extended to the south, and that the office tower would also require a height variance and a floor area ratio (FAR) variance to accomplish (re:  Case No. 04-032); and

            WHEREAS, it was offered that the building proposed at this location will provide 110,739 square feet of office space and 138,840 square feet of parking area (resulting in the establishment of 280 parking spaces) upon approximately 1.58 acres of land; and

            WHEREAS, it was explained that Conditional Use approval is also required (re:  Case No. 04-033) with respect to this office complex to grant specific authorization for a Parking Garage, noting that the garage will be constructed exclusively to satisfy the parking requirements generated by the proposed office complex, and not for commercial public parking use; and

            WHEREAS, after further discussion, the Planning Commission voted to continue this matter until their next meeting, wherein Keesler Air Force Base Representative, Don Kinman, would be present to discuss any height issues; and

            WHEREAS, on April 15, 2004, the Biloxi Planning Commission, upon careful reflection of the particulars of this case, voted to recommend approval of the applicants’ request to allow for the sale of tenant floor space to individuals within an approved office building complex (i.e., a vertical subdivision), having determined that said subdivision, as proposed, has been found to be in compliance with regulations and requirements associated with subdivision approvals, as contained within the Land Development Ordinance, subject to said subdivision meeting all requirements of the Development Review Committee, and subject  further to a parking distribution plan, acceptable to the City, which addresses the allocation of parking spaces within this complex, and subject further to Conditional Use approval for the parking garage and height and floor area ratio variances also being authorized, for the property located at 1877 Beach Boulevard; and

            WHEREAS, the Biloxi City Council, after consideration of all facts presented, hereby adopts the report and findings of the Biloxi Planning Commission and, in so doing, determines that approval of the applicants’ request for preliminary subdivision (condominium) approval, to allow for the sale of tenant floor space to individuals within an approved office building complex, is appropriate for the property located 1877 Beach Boulevard.

            NOW, THEREFORE, BE IT RESOLVED, THAT THE CITY COUNCIL OF THE CITY OF BILOXI, MISSISSIPPI, hereby authorizes preliminary subdivision approval, to allow for the sale of tenant floor space to individuals within an approved office building complex (i.e., a vertical subdivision), in Case No. 04-034, Sam Ly (owner) and Gulf Coast Investment Developers (applicant), for the property located at 1877 Beach Boulevard, having determined that said condominium subdivision, as proposed, has been determined to be in compliance with the Land Development Ordinance, subject to said subdivision meeting all requirements of the Development Review Committee, and subject further to a parking distribution plan, acceptable to the City be submitted by the applicants, which plan addresses an appropriate allocation of parking spaces within this complex, and subject also to the applicants exhibiting compliance with the terms and conditions which may be attached to any Conditional Use and Variance approvals granted with respect to this office complex.

            NOW, THEREFORE, BE IT RESOLVED, THAT THE CITY COUNCIL OF THE CITY OF BILOXI, MISSISSIPPI, will conduct a public hearing in reference to Case No. 04-034, Sam Ly (owner) and Gulf Coast Investment Developers (applicant), on a date to be set and in accordance with all requirements as prescribed by the City of Biloxi Zoning Ordinance governing the conduct of public hearings.
