RESOLUTION AUTHORIZING VESSEL SALE, LIEN RELEASE AND SUIT DISMISSAL

(the BAJA, Andrea Griffiths)

 

WHEREAS, the City of Biloxi, by and through the City of Biloxi Port Division, had entered into a Berth Rental Agreement with Andrea Griffiths, an adult resident of Walls, MS, for the purpose of docking Andrea Griffiths’ vessel, the BAJA, at the Biloxi Small Craft Harbor; and,

WHEREAS, Andrea Griffiths has become delinquent in her dockage rental fees in the amount of Four Thousand Five Hundred Seventy-Two and No/100 Dollars ($4,572.00), and the City has incurred attorney’s fees related to the collection of the delinquent dockage fees; and,

WHEREAS, Andrea Griffiths has sold all her rights, title and interest in the BAJA to Michael T. Wood; and,

WHEREAS, the City of Biloxi deems it to be within the best interests of the City to enter into a mutually agreeable settlement with Michael T. Wood regarding delinquent dockage fees on the BAJA.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BILOXI, MISSISSIPPI, that:

Section 1:  The City hereby authorizes Frank Duggan, Director, City of Biloxi Port Division, to execute a Bill of Sale to Michael T. Wood (a specimen copy of which is attached hereto) whereby the City shall convey to Michael T. Wood all its right, title and interest in the BAJA for and in consideration of the sum of Three Thousand Eight Hundred and No/100 Dollars ($3,800.00), which represents the payment of delinquent dockage fees and attorney’s collection fees related thereto.

Section 2:  The City hereby authorizes the law firm of Page, Mannino, Peresich & McDermott, PLLC, to release the Notice of Lien for Dockage Charges filed in the office of the Chancery Clerk, Second Judicial District, Harrison County, Mississippi, against the BAJA and in favor of the City.

Section 3:  The City hereby authorizes the law firm of Page, Mannino, Peresich & McDermott, PLLC, to dismiss the Complaint for Foreclosure on Lien on Water Craft filed in the Circuit Court of Harrison County, Mississippi, Second Judicial District, against the Defendant Andrea Griffiths.
