RESOLUTION NO._____
WHEREAS, on July 29, 2009, bids were received for CDBG Project No. R-103-122-01-KCR, Lighthouse Park and Visitors Center; and
WHEREAS, Rod Cooke Construction, Inc. submitted the lowest and best bid in the amount of $7,174,312.00; and
WHEREAS, on August 18, 2009, Resolution No. 450-09 authorized The Mayor and/or Municipal Clerk to execute a contract with Rod Cooke Construction, Inc. for CDBG Project No. R-103-122-01-KCR, Lighthouse Park and Visitors Center in the amount not to exceed $7,174,312.00; and
WHEREAS, on September 22, 2009, Resolution No. 543-09 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 1 in an amount not to exceed $5,745.00, for a revised contract total of $7,180,057.00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, on April 6, 2010, Resolution No. 168-10 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 2 in an amount not to exceed $39,829.00, and a time extension of 10 days to extend the contract ending date from February 22, 2011 to March 4, 2011for a revised contract total of $7,219, 886.00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, on May 4, 2010, Resolution No. 218-10 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 3 for a change in roof materials from Slate to a Clay Roof Tile at no change in cost for a contract total of $7,219, 886.00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, on June 1, 2010, Resolution No. 269-10 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 4 in an amount not to exceed $17,368.00, for a revised contract total of $7,237,254.00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, on July 6, 2010, Resolution No.347-10 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 5 in an amount not to exceed $8,295.00, and a time extension of 34 days to extend the contract ending date from March 4, 2011 to April 7, 2011 for a revised contract total of $7,245,549.00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, on March 15, 2011, Resolution No.121-11 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 6 in an amount not to exceed $265,141.00, and a time extension of 20 days to extend the contract ending date from April 7, 2011 to April 27, 2011 for a revised contract total of $7,510,690.00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, on April 26, 2011, Resolution No.177-11 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 7 in an amount not to exceed $ 42,032.00, and a time extension of 35 days to extend the contract ending date from April 27, 2011 to June 1, 2011 for a revised contract total of $7,552,722.00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, on May 24, 2011, Resolution No.242-11 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 8 for a time extension of 16 days to extend the contract ending date from June 1, 2011 to June 17, 2011, and no change in cost for a contract total of $7,552,722.00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, on June 21, 2011, Resolution No.291-11 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 9 in an amount not to exceed $ 57,216.00, and a time extension of 27 days to extend the contract ending date from June 17, 2011 to July 14, 2011 for a revised contract total of $7,609,938.00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, on July 5, 2011, Resolution No.324-11 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 10 in an amount not to exceed $ 20,482.00, for a revised contract total of $7,630,420.00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, on July 19, 2011, Resolution No.370-11 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 11 in an amount not to exceed $46,381.00, and a time extension of 22 days to extend the contract ending date from July 14, 2011 to August 5, 2011 for a revised contract total of $7,676,801..00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, on September 20, 2011, Resolution No.503-11 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 12 in an amount not to exceed $50,005.00, for a revised contract total of $7,726,806.00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, on October 4, 2011, Resolution No.547-11 authorized The Mayor and/or Municipal Clerk to accept Change Order No. 13 in an amount not to exceed $72,904.00, for a revised contract total of $7,799,710.00 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center; and
WHEREAS, it is the recommendation of Richard Sullivan, Director of Public Works, and Damon Torricelli, City Engineer, and City’s Project Architect, Dale & Associates Architects, P.A., to accept Change Order No. 14 in an amount not to exceed $13,253.63, for a revised contract total of $7,812,963.63 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BILOXI, MISSISSIPPI, THAT:
SECTION ONE. The findings, conclusions, and statements of fact contained in the foregoing preamble are hereby adopted, ratified, and incorporated herein.
SECTION TWO. The Mayor and/or Municipal Clerk be, and hereby, are authorized to accept the Change Order No. 14 in an amount not to exceed $13,253.63, for a revised contract total of $7,812,963.63 for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center.
SECTION THREE. The Mayor and/or Municipal Clerk be, and hereby are, authorized to enter into and execution the Change Order No. 14 in the substantially the same form as that attached hereto as Exhibit “A”, with Rod Cooke Construction, Inc. for CDBG Project No. R-103-122-01-KCR, the Lighthouse Park and Visitors Center.
