RESOLUTION NO.

            WHEREAS, the City of Biloxi, Mississippi is an "Entitlement City" under the provisions of the United States Department of Housing and Urban Development (HUD) Community Development Block Grant Program (CDBG); and

            WHEREAS, HUD requires the City to follow the procurement policies set forth in 24CRF 85; and

            WHEREAS, on February 15, 2012, the City of Biloxi accepted proposals for Legal Services for the City of Biloxi’s CDBG Program in compliance with State Law, HUD Regulations, and the City of Biloxi’s Code of Ordinances; and

            WHEREAS, the CDBG procurement Selection Committee recommended the selection of  Page, Mannino, Peresich & McDermott PLLC to perform the aforementioned services and the Director of Administration concurred with the recommendations; and

            WHEREAS, currently, funding for legal services is included in the 2012 CDBG Budget; and

                        NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF BILOXI, MISSISSIPPI, THAT:

Section One.   The Mayor and/or Municipal Clerk are hereby authorized to accept the bid from Page, Mannino, Peresich & McDermott PLLC to perform legal services at a fixed rate of $110.00 and Paralegal and Administrative work at a fixed rate of $55.00 for the CDBG Program. Allowable additional billing charges will include any filing fees, copy charges, long distance calls, and third party charges.

Section Two.   The Mayor and/or Municipal Clerk are hereby authorized to execute a contract with Page, Mannino, Peresich & McDermott PLLC in substantially the same form as the one hereto attached.
